Terms of Service

These Terms govern your use of My SocialOS, the AI Social Operating System. They are written to be readable — please actually read them. The short version: you own your content, you are responsible for what you approve and publish, we provide the platform honestly and protect it accordingly, and third-party platforms play by their own rules.

1. Acceptance of These Terms

These Terms of Service (the “Terms”) are an agreement between you and My SocialOS (“My SocialOS,” “we,” “us”). By creating an account, accessing, or using the My SocialOS website or services (the “Service”), you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a business or other organization, you represent that you have authority to bind that organization, and “you” refers to it as well. If you do not agree to these Terms, do not use the Service.

2. What My SocialOS Is

My SocialOS is an AI-powered social media management platform. Depending on your plan and the features available to your account, the Service can assist you with things such as: content ideation and strategy, AI-assisted content generation (copy, visuals, and audio elements), weekly and monthly content planning, a content calendar and scheduling with recommended posting times, campaign creation, review and approval workflows, management of brand and product assets, and — where you connect a supported social media account — scheduling and publishing content to that account.

Features vary by plan and evolve over time. Some capabilities (for example, publishing to a particular social platform) become available only when the relevant integration is supported and you have connected and authorized the corresponding account.

3. Eligibility and Your Account

You must be able to form a binding contract to use the Service, and you must meet the age requirement in Section 15 of our Privacy Policy (at least 16, and at least 13 in all cases with authority to agree to these Terms — the Service is not directed to children). You agree to provide accurate account information and keep it current. You are responsible for safeguarding your login credentials, for all activity that occurs through your account, and for notifying us promptly of any unauthorized access or use. Accounts belong to the person or organization that registered them; access must not be shared in ways that circumvent plan limits.

4. Subscriptions, Billing, and Payment

My SocialOS is a paid subscription service. By subscribing, you authorize us and our payment processor (currently Stripe) to charge your payment method the applicable subscription fee on a recurring basis for your selected billing period, plus any applicable taxes, until you cancel. Unless stated otherwise at checkout, subscriptions renew automatically at the end of each billing period.

  • Plan changes. You may upgrade or downgrade between available plans; changes take effect as described at the time of the change (for example, at the next billing period or immediately with proration, as presented in the billing flow).
  • Included features and fair use.Features described as “included” (such as Remi, AI content creation, and automatic publishing) are provided for ordinary human use of the Service. We may limit or suspend clearly abnormal automated, scripted, or abusive consumption that materially threatens platform stability or creates abnormal infrastructure load; such measures are never used to restrict ordinary active use.
  • Metered allowances and add-ons. Some capabilities (for example original posts created per month, Repurpose Content minutes, AI voiceovers, connected social accounts, and media storage) carry per-billing-period or capacity allowances stated at purchase. Publishing one original post across multiple connected networks counts as one post — platform adaptations do not consume additional allowance. Certain networks may be offered as optional add-ons separate from the standard included accounts. One-time capacity add-ons (such as additional Repurpose minutes) are usable through the billing period in which they are purchased and do not roll over; recurring add-ons (such as additional storage) renew with your subscription until removed. Allowance details are presented before purchase.
  • Introductory pricing. Promotional or introductory subscription pricing (such as early-customer launch pricing) applies to the base subscription price of the qualifying plan for as long as that subscription remains continuously active, and does not apply to add-ons, which are priced independently and may change. If a qualifying subscription is cancelled or expires, the introductory price ends and any new subscription is offered at then-current pricing. Introductory pricing is a price commitment for an active subscription, not a lifetime right of access to the Service.
  • Cancellation. You can cancel your subscription at any time through the billing controls in the app. Unless we state otherwise, cancellation stops future renewals, and access to paid features continues through the end of the period already paid for.
  • Failed payments. If a charge fails, we may retry it and may suspend or limit access to paid features until payment is resolved.
  • Pricing changes. We may change prices or introduce new plans. Price changes for an existing subscription take effect at a subsequent renewal after reasonable notice.
  • Refunds. Except where required by law or expressly stated by us in writing, payments are non-refundable.

5. Plans and Usage Allowances

AI-assisted and API-intensive functionality consumes real computing resources. Plans (such as Creator, Business, and Agency tiers) may include different usage allowances — for example, limits on generated content, connected platforms, or other metered functionality. Usage beyond an included allowance may be unavailable or may require additional payment. Specific allowances, overage options, and their pricing are described in the product and may change over time. Availability of AI functionality also depends on third-party AI and API providers, and may be affected by their capacity, policies, or outages.

6. AI-Generated Content

My SocialOS uses artificial intelligence to help generate, adapt, and recommend content, including text, visual compositions, voiceover, and music selections, and to recommend things like posting schedules. AI output is a starting point produced by statistical systems: it may occasionally contain errors, inaccuracies, repetition, content you consider off-brand, or suggestions that are not appropriate for your situation.

  • You are responsible for reviewing content before it is published. Where the Service provides an approval step, content you approve (or instruct the Service to publish) is your content decision.
  • You are responsible for ensuring content you publish complies with applicable laws and with the rules of the platform it is published to.
  • We do not guarantee that AI-generated content will be accurate, unique, lawful for your specific use, or that it will achieve any particular engagement, reach, conversion, or business result.

7. Connected Social Media Accounts

The Service is designed to work with third-party social platforms, which may include Instagram, Facebook, Threads, X, LinkedIn, TikTok, YouTube, and Pinterest, where and when each integration is supported for your account. When you connect a social account, you authorize My SocialOS — through that platform’s official APIs and authorization (OAuth) flows — to access the account and perform the functions you direct, such as publishing approved content.

  • You must own or have authority over any account you connect.
  • Your use of each platform remains governed by that platform’s own terms and policies, which you are responsible for complying with. Connecting an account does not transfer its ownership to us.
  • We do not control third-party platforms. Their API changes, rate limits, outages, policy changes, or revocation of permissions can affect or interrupt functionality, and we are not responsible for their actions or decisions.
  • You may disconnect a supported social account at any time via the Service or the platform’s own settings.

8. Scheduling and Publishing

Where publishing is available, you may instruct the Service to schedule content for a future time or publish it to a connected account. Scheduled and immediate publishing are performed on your instruction and are subject to the availability of our systems and the destination platform. Delivery at an exact moment cannot be absolutely guaranteed: third-party APIs may delay, reject, or fail content, and we may use reasonable retry and recovery processes when a publish attempt fails. Content remains your responsibility once you authorize it for publication. You can generally cancel or reschedule content until execution has begun; if a publish attempt is already underway, we will report the actual outcome rather than reversing it.

9. Your Content and Brand Assets

You may provide content and materials to the Service — for example logos, images, video, audio, brand information, product information, copy, prompts, and instructions (collectively, “User Content”). You own your User Content. You grant My SocialOS a worldwide, non-exclusive license to host, store, reproduce, process, adapt, transform, generate derivative content from, display, schedule, publish, and transmit User Content solely as needed to operate, provide, secure, and improve the Service and to carry out the actions you request (including delivering content to platforms you connect). This license ends when the content is deleted from the Service, except for copies reasonably retained in backups or as required for legal or audit purposes.

You represent that you have all rights necessary to your User Content and to anything you instruct the Service to publish, and that it does not infringe the rights of others or violate any law.

10. My SocialOS Intellectual Property

The Service — including its software, interface, design, branding, logos, workflows, templates, proprietary technology, and documentation — is owned by My SocialOS or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights in the Service are transferred to you. You may not copy, modify, reverse engineer, resell, or create derivative works of the Service except as permitted by law. This section does not affect your ownership of your User Content.

11. Acceptable Use

You agree not to use the Service to:

  • violate any law or the rights of others, including intellectual-property and privacy rights;
  • publish or distribute unlawful, infringing, or deceptive content, or engage in spam or coordinated manipulation;
  • access or attempt to access accounts, systems, or data without authorization;
  • misuse third-party platforms or their APIs, or connect social accounts you are not authorized to control;
  • upload or transmit malware, or attempt to probe, bypass, or defeat security measures;
  • interfere with the operation of the Service, including abusive automated access or attempts to exceed plan limits by artificial means;
  • engage in fraudulent activity, including payment fraud.

12. Third-Party Services

The Service depends on third-party providers to operate — including social media platforms and their APIs, artificial-intelligence providers, cloud hosting and database infrastructure, payment processing, and licensed media libraries. Third-party services are governed by their own terms, and their availability, behavior, and policies are outside our control. We are not liable for failures or changes in third-party services, though we will make reasonable efforts to adapt the Service when they occur.

13. Service Availability and Changes

We are continuously improving My SocialOS. We may add, modify, or remove features, perform maintenance, and make changes needed to respond to technical, security, legal, or third-party platform requirements. We do not promise that the Service will be uninterrupted or error-free. Where a change materially reduces core paid functionality, we will use reasonable efforts to notify affected subscribers.

14. Suspension and Termination

We may suspend or terminate access to the Service, or limit particular features, where we reasonably believe it is necessary — for example for violations of these Terms, fraud or abuse, non-payment, security risks, legal requirements, or misuse of connected platforms. Where practical, we will give notice and an opportunity to remedy the issue first. You may stop using the Service and cancel your subscription at any time as described in Section 4. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) survive.

15. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that content generated or published through the Service will meet your requirements or produce any particular outcome, or that the Service will be available at any particular time or free of errors.

16. Limitation of Liability

To the fullest extent permitted by law: (a) My SocialOS will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, or data, arising out of or related to the Service, even if advised of the possibility; and (b) our total aggregate liability for all claims arising out of or relating to the Service will not exceed the amounts you paid to My SocialOS for the Service in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless My SocialOS and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of: your User Content; content you approve or instruct the Service to publish; your violation of these Terms or of applicable law; infringement of third-party rights by material you provide; your misuse of connected social accounts; or your violation of a third-party platform’s rules.

18. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Subject to any applicable mandatory consumer protections in your place of residence, disputes arising out of these Terms or the Service will be resolved in the state or federal courts located in Texas, and both parties consent to their jurisdiction.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page, and for material changes we will provide reasonable notice (for example in the app or by email). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
